Terms of Service

The agreement governing access to and use of the Service.

Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and ANYTALE LLC (“ANYTALE”, “we”, “us”) governing your access to and use of AnyTale RPG (the “Service”).

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are under 18, you represent you have permission from a parent or legal guardian.

2. Accounts and security

  • You are responsible for your account and all activity under it.
  • Keep your login credentials confidential. Notify us if you suspect unauthorized access.
  • We may suspend or terminate accounts to protect the Service or other users.

3. The Service (what it is)

The Service is a web platform for roleplay and tabletop RPG features, which may include (without limitation): campaigns, characters/sheets, in-game chat (including whispers), direct messages, social posts/comments/likes/follows, notifications, communities, LFG posts, reviews, and related tools.

The Service may change over time. Features may be added, removed, or modified at any time.

4. User content and license

A. Your content

“User Content” means anything you or other users submit to the Service, including text, images, characters, sheets, campaign data, chat logs, posts, comments, and messages.

You retain ownership of your User Content as between you and ANYTALE. You represent and warrant that:

  • You have all rights needed to submit your User Content.
  • Your User Content does not violate law or the rights of others.

B. License you grant us

You grant ANYTALE a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/technical processing), publicly display, publicly perform, distribute, and otherwise use your User Content as necessary to operate, provide, maintain, and improve the Service, including to display your content to other users according to your settings (e.g., public campaigns/profiles).

C. Visibility and confidentiality

Roleplay and social features are inherently social. You understand that:

  • Content you share with other users (including campaign logs, messages, and uploads) may be viewed, copied, re-shared, or captured by those users.
  • Uploads served via public URLs may be accessible to anyone who has the link.

Do not upload or share anything you consider confidential or sensitive.

5. AI features (important)

The Service may offer AI-assisted features (for example: rewriting/polishing text, summaries, NPC actions, referee interpretations, system-building tools, image/avatar generation, and in-app assistants). If you use AI features, you instruct us to process the relevant input, uploaded/generated media, metadata, and context to generate outputs, including by sending data to third-party AI infrastructure providers, model providers, routing/proxy providers, safety/moderation providers, and related service providers selected by us.

Our AI provider stack may change over time. We may add, remove, replace, or route between providers, models, gateways, proxies, safety systems, or inference infrastructure without updating these Terms each time.

Depending on the feature, AI context may include your prompt, recent campaign messages/logs, other players’ messages in the same campaign, scene details, character/sheet data, lore/world data, GM notes/secrets, roll data, page context, account tier, quota/credit state, and routing metadata. Do not use AI features for information you are not comfortable sending to external AI infrastructure.

AI outputs:

  • May be inaccurate, incomplete, biased, or unsafe.
  • Are provided for entertainment and convenience only and are not professional advice (including legal, medical, financial, or safety advice).
  • Must be reviewed by you before use. You are solely responsible for how you use AI outputs.
  • May be similar or identical to outputs provided to other users due to the nature of generative systems.
  • Are not guaranteed to be unique, copyrightable, available, uninterrupted, secure, or suitable for any particular purpose.

You agree not to submit passwords, API keys, payment card data, or other sensitive personal data into AI prompts.

We may limit, throttle, block, log, review, or refuse AI requests to enforce quotas, paid plan limits, fair-use rules, safety rules, provider requirements, abuse-prevention measures, or applicable law. AI providers may also reject, delay, rate-limit, retain, or process requests under their own rules. We are not liable for provider outages, model changes, routing changes, refused generations, hallucinations, lost context, degraded quality, or increased latency.

6. Paid features, subscriptions, credits, and billing

The Service may offer paid subscriptions, support plans, add-ons, AI credit packs, storage-related benefits, campaign-owner-funded media storage, donations, or other paid features (“Paid Features”). Paid Features are offered only where available and may change over time.

A. Payment processor

Payments are processed by third-party payment processors such as Stripe or similar providers. By purchasing Paid Features, you agree to the payment processor’s applicable terms and authorize the processor to charge your selected payment method for the amounts shown at checkout, including recurring subscription charges where applicable.

We do not store full payment card numbers. We may store payment processor IDs, product selections, subscription status, invoice/payment identifiers, billing acceptance records, credit balances, usage records, dispute/chargeback records, and related audit logs.

B. Subscriptions and cancellation

Subscriptions renew automatically unless canceled before the renewal date. You are responsible for canceling subscriptions you no longer want through the billing portal or other cancellation flow we provide.

Canceling a subscription stops future renewals but does not automatically refund prior charges. Unless we state otherwise, subscription benefits continue until the end of the paid billing period, subject to these Terms and any abuse, fraud, or violation enforcement.

We may change prices, plan names, included benefits, quotas, model access, storage limits, AI routes, or feature availability. If required by law or by the payment processor, we will provide notice or obtain consent for material recurring price changes.

C. AI credits, quotas, and fair use

AI credits, included monthly usage, quotas, unlimited-style features, BYOK-related access, storage benefits, and similar entitlements are Service access rights, not cash, stored value, property, or currency. They are non-transferable, have no cash value, and may not be sold, exchanged, refunded, or redeemed except where required by law.

We may meter AI and storage usage using estimates, reservations, provider-reported usage, internal routing data, or other reasonable technical methods. Usage measurements may not match a third-party provider’s exact token or cost accounting.

“Unlimited,” “included,” “fair use,” or similar wording does not mean unrestricted use. We may apply rate limits, queueing, concurrency limits, abuse limits, provider limits, safety limits, maintenance limits, or manual review to protect the Service, other users, providers, and our business.

D. Refunds

Except where required by applicable law or expressly stated by us in writing:

  • Subscriptions are not refundable after the subscription access, benefits, AI credits, storage benefits, or other paid features have been used during the billing period.
  • One-time AI credit packs, donations, support payments, and other one-time purchases are non-refundable once delivered, credited, used, partially used, or associated with Service access.
  • We do not provide refunds for unused time after cancellation, user error, accidental purchases, failure to cancel, dissatisfaction with AI output quality, model/provider changes, temporary downtime, rate limits, refused AI generations, storage limits, account suspension for violations, or loss of access caused by your breach of these Terms.

We may choose to issue a refund or credit at our sole discretion. Doing so does not waive our rights or create an obligation to provide future refunds.

E. Chargebacks and disputes

If you initiate a chargeback, payment dispute, reversal, or similar claim, we may provide relevant account, billing, acceptance, usage, login, support, and delivery evidence to the payment processor, bank, card network, or dispute-resolution provider. We may suspend, limit, or terminate Paid Features while a payment is disputed or unpaid.

Fraudulent, abusive, or bad-faith payment activity may result in account suspension or termination.

7. Push notifications

The Service may offer optional web or PWA push notifications. If you enable them, you authorize us to send Service-related notifications to your browser or device, including game, campaign, social, account, billing, or system notifications depending on your settings.

Notification delivery is not guaranteed. Notifications may be delayed, missed, duplicated, or visible to anyone with access to your device or browser. If you enable preview text, notification content may reveal message, campaign, whisper, or other private context on your device lock screen or notification center. You are responsible for your notification settings and device security.

You can disable notifications through the Service settings, browser/device settings, or by removing the browser/device subscription where supported.

8. Prohibited conduct

You agree not to:

  • Break the law or encourage wrongdoing.
  • Harass, threaten, defame, or abuse others; or engage in hate-based harassment.
  • Submit sexual content involving minors or any content exploiting minors (zero tolerance).
  • Attempt to bypass authentication/authorization, scrape private data, probe the Service, or abuse real-time features.
  • Upload malware or non-permitted content types, or use uploads to deliver harmful code.
  • Interfere with or disrupt the Service (including via excessive requests or attacks).
  • Impersonate others or misrepresent your identity.
  • Infringe intellectual property rights.
  • Abuse Paid Features, AI credits, subscriptions, storage, rate limits, referrals, promotions, chargebacks, refunds, trials, or billing systems.
  • Use AI or roleplay features to generate, request, distribute, or facilitate illegal content, child exploitation, sexualized minors, non-consensual sexual content, doxxing, real-world threats, malware, credential theft, fraud, or other harmful activity.

We may remove content and/or suspend or terminate accounts for violations, at our sole discretion.

9. Community moderation and safety

We may (but are not obligated to) monitor, review, or remove User Content. We may investigate reports and take enforcement actions. We are not responsible for User Content posted by users.

10. Third-party services and links

The Service may rely on or integrate with third-party services (for example, hosting/infrastructure providers, object storage/CDN providers, payment processors, push-notification infrastructure, analytics/observability providers, AI gateways/proxies, AI model/inference providers, image-generation providers, safety/moderation providers, and other operational providers). Your use of third-party services may be subject to their separate terms and privacy policies. We are not responsible for third-party services.

11. Privacy

Our Privacy Policy explains how we collect and use information. It is incorporated by reference into these Terms: see Privacy Policy.

12. Service availability; beta features

The Service is provided “AS IS” and “AS AVAILABLE.” Downtime, data loss, bugs, and security incidents may occur. Some features may be experimental or in “beta.”

We do not guarantee uninterrupted operation, error-free performance, provider availability, AI model availability, storage availability, push notification delivery, or that content will always be preserved.

13. Disclaimers

To the maximum extent permitted by law:

  • ANYTALE disclaims all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
  • ANYTALE does not guarantee that campaigns, chat logs, dice/roll outcomes, AI outputs, or other content will meet your expectations or be accurate.
  • ANYTALE is not responsible for interactions between users, including disputes, harassment, or any offline consequences.
  • ANYTALE does not guarantee that Paid Features, AI credits, quotas, storage capacity, model access, provider routes, generation quality, response speed, or billing integrations will remain unchanged.

14. Limitation of liability

To the maximum extent permitted by law:

  • ANYTALE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, even if advised of the possibility.
  • ANYTALE’s total liability arising out of or relating to the Service will not exceed the greater of (a) USD $100 or (b) the amount you paid to ANYTALE for the Service in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless ANYTALE and its owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of the Service,
  • Your User Content,
  • Your violation of these Terms or applicable law,
  • Your infringement of any rights of any other person or entity.
  • Your payment disputes, chargebacks, refund abuse, fraudulent transactions, or misuse of Paid Features, except to the extent caused by ANYTALE’s own unlawful conduct.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe:

  • you violated these Terms,
  • your use poses risk to the Service or others,
  • we must do so to comply with law, or
  • we choose to discontinue the Service (in whole or in part).

Termination may result in loss of access to campaigns, User Content, Paid Features, unused credits, storage benefits, AI access, and other Service functionality. Except where required by law, termination or suspension for violation of these Terms does not entitle you to a refund.

Upon termination, sections that by their nature should survive will survive (including licenses necessary to operate the Service, payment obligations, billing/dispute records, disclaimers, limitation of liability, indemnification, and dispute resolution).

17. Changes to these Terms

We may modify these Terms at any time. The updated Terms will be effective when posted with a new “Last updated” date (or as otherwise stated).

If you continue using the Service after changes become effective, you agree to the updated Terms.

Changes apply prospectively. Disputes arising before the effective date of an updated version will be governed by the version of the Terms in effect when the dispute arose, unless applicable law requires otherwise.

18. Governing law; dispute resolution

A. Governing law and venue (if not arbitrated)

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. If a dispute is not subject to arbitration (or arbitration is found unenforceable), the parties agree to exclusive jurisdiction and venue in state or federal courts located in Bernalillo County, New Mexico.

B. Binding arbitration; class action waiver

Except for disputes that qualify for small claims court or requests for injunctive relief to stop misuse of intellectual property or unauthorized access, you and ANYTALE agree to resolve disputes through binding individual arbitration, and not in court, to the fullest extent permitted by law.

You and ANYTALE agree that:

  • Arbitration will be conducted on an individual basis only.
  • You waive any right to bring or participate in a class action, class arbitration, or representative action against ANYTALE.

Arbitration provider and rules: unless we both agree otherwise, arbitration will be administered by AAA (American Arbitration Association) under its applicable rules. The arbitration may be conducted remotely (e.g., by video/phone) where appropriate.

If this arbitration clause is found unenforceable in whole or in part, the unenforceable portion will be severed and the remainder will be enforced to the maximum extent permitted.

19. Intellectual property

The Service, including software, design, trademarks, logos, and content provided by ANYTALE (excluding User Content), is owned by ANYTALE or its licensors and is protected by law. You may not copy, modify, distribute, sell, or lease any part of the Service except as allowed by these Terms or applicable law.

20. Feedback

If you provide suggestions or feedback, you grant ANYTALE a perpetual, irrevocable, worldwide, royalty-free license to use it without compensation or obligation.

21. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and ANYTALE regarding the Service.
  • Severability. If any provision is unenforceable, the rest remains in effect.
  • No waiver. Failure to enforce a provision is not a waiver.
  • Assignment. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, restructuring, or asset sale.
  • Electronic notices. You consent to receive notices and communications electronically (e.g., in-product notices, email, or posting on the Service). Electronic notices satisfy any legal requirement that such notices be in writing.

22. Copyright (DMCA) notice

If you believe content on the Service infringes your copyright, send a notice to: dmca@anytalerpg.com.

Your notice should include: identification of the copyrighted work, identification of the allegedly infringing material (with a URL or sufficient detail to locate it), your contact information, a statement of good-faith belief, a statement made under penalty of perjury that the information is accurate and you are authorized to act, and a physical or electronic signature.
