Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and ANYTALE
LLC (“ANYTALE”, “we”, “us”) governing your access to and use of AnyTale
RPG (the “Service”).
If you do not agree, do not use the Service.

1) Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are under 18, you represent you have permission from a parent or legal guardian.
2) Accounts and security
- You are responsible for your account and all activity under it.
- Keep your login credentials confidential. Notify us if you suspect unauthorized access.
- We may suspend or terminate accounts to protect the Service or other users.
3) The Service (what it is)
The Service is a web platform for roleplay and tabletop RPG features, which may include (without limitation): campaigns, characters/sheets, in-game chat (including whispers), direct messages, social posts/comments/likes/follows, notifications, communities, LFG posts, reviews, and related tools.
The Service may change over time. Features may be added, removed, or modified at any time.
4) User content and license
A. Your content
“User Content” means anything you or other users submit to the Service, including text, images, characters, sheets, campaign data, chat logs, posts, comments, and messages.
You retain ownership of your User Content as between you and ANYTALE. You represent and warrant that:
- You have all rights needed to submit your User Content.
- Your User Content does not violate law or the rights of others.
B. License you grant us
You grant ANYTALE a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/technical processing), publicly display, publicly perform, distribute, and otherwise use your User Content as necessary to operate, provide, maintain, and improve the Service, including to display your content to other users according to your settings (e.g., public campaigns/profiles).
C. Visibility and confidentiality
Roleplay and social features are inherently social. You understand that:
- Content you share with other users (including campaign logs, messages, and uploads) may be viewed, copied, re-shared, or captured by those users.
- Uploads served via public URLs may be accessible to anyone who has the link.
Do not upload or share anything you consider confidential or sensitive.
5) AI features (important)
The Service may offer AI-assisted features (for example: rewriting/polishing text, summaries, NPC actions, referee interpretations, and in-app assistants). If you use AI features, you instruct us to process the relevant input and context to generate outputs, including by sending data to third-party AI providers.
AI outputs:
- May be inaccurate, incomplete, biased, or unsafe.
- Are provided for entertainment and convenience only and are not professional advice (including legal, medical, financial, or safety advice).
- Must be reviewed by you before use. You are solely responsible for how you use AI outputs.
You agree not to submit passwords, API keys, payment card data, or other sensitive personal data into AI prompts.
6) Prohibited conduct
You agree not to:
- Break the law or encourage wrongdoing.
- Harass, threaten, defame, or abuse others; or engage in hate-based harassment.
- Submit sexual content involving minors or any content exploiting minors (zero tolerance).
- Attempt to bypass authentication/authorization, scrape private data, probe the Service, or abuse real-time features.
- Upload malware or non-permitted content types, or use uploads to deliver harmful code.
- Interfere with or disrupt the Service (including via excessive requests or attacks).
- Impersonate others or misrepresent your identity.
- Infringe intellectual property rights.
We may remove content and/or suspend or terminate accounts for violations, at our sole discretion.
7) Community moderation and safety
We may (but are not obligated to) monitor, review, or remove User Content. We may investigate reports and take enforcement actions. We are not responsible for User Content posted by users.
8) Third-party services and links
The Service may rely on or integrate with third-party services (for example, hosting/infrastructure providers, object storage/CDN providers, and AI providers). Your use of third-party services may be subject to their separate terms and privacy policies. We are not responsible for third-party services.
9) Privacy
Our Privacy Policy explains how we collect and use information. It is incorporated by reference into these Terms: see Privacy Policy.
10) Service availability; beta features
The Service is provided “AS IS” and “AS AVAILABLE.” Downtime, data loss, bugs, and security incidents may occur. Some features may be experimental or in “beta.”
We do not guarantee uninterrupted operation, error-free performance, or that content will always be preserved.
11) Disclaimers
To the maximum extent permitted by law:
- ANYTALE disclaims all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- ANYTALE does not guarantee that campaigns, chat logs, dice/roll outcomes, AI outputs, or other content will meet your expectations or be accurate.
- ANYTALE is not responsible for interactions between users, including disputes, harassment, or any offline consequences.
12) Limitation of liability
To the maximum extent permitted by law:
- ANYTALE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data, even if advised of the possibility.
- ANYTALE’s total liability arising out of or relating to the Service will not exceed the greater of (a) USD $100 or (b) the amount you paid to ANYTALE for the Service in the 12 months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13) Indemnification
You agree to defend, indemnify, and hold harmless ANYTALE and its owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use of the Service,
- Your User Content,
- Your violation of these Terms or applicable law,
- Your infringement of any rights of any other person or entity.
14) Termination
You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe:
- you violated these Terms,
- your use poses risk to the Service or others,
- we must do so to comply with law, or
- we choose to discontinue the Service (in whole or in part).
Upon termination, sections that by their nature should survive will survive (including licenses necessary to operate the Service, disclaimers, limitation of liability, and dispute resolution).
15) Changes to these Terms
We may modify these Terms at any time. The updated Terms will be effective when posted with a new “Last updated” date (or as otherwise stated).
If you continue using the Service after changes become effective, you agree to the updated Terms.
Changes apply prospectively. Disputes arising before the effective date of an updated version will be governed by the version of the Terms in effect when the dispute arose, unless applicable law requires otherwise.
16) Governing law; dispute resolution
A. Governing law and venue (if not arbitrated)
These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. If a dispute is not subject to arbitration (or arbitration is found unenforceable), the parties agree to exclusive jurisdiction and venue in state or federal courts located in Bernalillo County, New Mexico.
B. Binding arbitration; class action waiver
Except for disputes that qualify for small claims court or requests for injunctive relief to stop misuse of intellectual property or unauthorized access, you and ANYTALE agree to resolve disputes through binding individual arbitration, and not in court, to the fullest extent permitted by law.
You and ANYTALE agree that:
- Arbitration will be conducted on an individual basis only.
- You waive any right to bring or participate in a class action, class arbitration, or representative action against ANYTALE.
Arbitration provider and rules: unless we both agree otherwise, arbitration will be administered by AAA (American Arbitration Association) under its applicable rules. The arbitration may be conducted remotely (e.g., by video/phone) where appropriate.
If this arbitration clause is found unenforceable in whole or in part, the unenforceable portion will be severed and the remainder will be enforced to the maximum extent permitted.
17) Intellectual property
The Service, including software, design, trademarks, logos, and content provided by ANYTALE (excluding User Content), is owned by ANYTALE or its licensors and is protected by law. You may not copy, modify, distribute, sell, or lease any part of the Service except as allowed by these Terms or applicable law.
18) Feedback
If you provide suggestions or feedback, you grant ANYTALE a perpetual, irrevocable, worldwide, royalty-free license to use it without compensation or obligation.
19) Export and sanctions compliance
You represent that you are not located in, and will not use the Service in, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. restricted party list, to the extent applicable.
20) Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and ANYTALE regarding the Service.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, restructuring, or asset sale.
- Electronic notices. You consent to receive notices and communications electronically (e.g., in-product notices, email, or posting on the Service). Electronic notices satisfy any legal requirement that such notices be in writing.
21) Copyright (DMCA) notice
If you believe content on the Service infringes your copyright, send a notice to:
anytalerpg@gmail.com.
Your notice should include: identification of the copyrighted work, identification of the allegedly
infringing material (with a URL or sufficient detail to locate it), your contact information, a
statement of good-faith belief, a statement made under penalty of perjury that the information is
accurate and you are authorized to act, and a physical or electronic signature.
